We may update this Privacy Statement from time to time by posting a revised Statement on our Website that reflects a new “Effective Date.” You are encouraged to stay informed of our privacy practices by frequently visiting this area of our Website. Your continued use of our Website after we make any changes means that you consent to those changes.

Please note that our Website may include links to other websites that we do not operate or maintain, and whose privacy practices may differ from ours. This Statement applies only to Pure Wafer’s processing activities and does not apply to any processing activities associated with any other websites or any information processed or collected by us offline.

  • contact information, such as your name, email address, phone number, and company name,
  • payment information, such as your credit card number,
  • information you choose to provide to us on our Website, by phone or through email, such as questions, comments or reviews about our products or services,
  • product and service preference, purchase, use, and customer service history,
  • data gathered automatically by technology when you visit our site, and
  • if you apply for a job with us, your resume, cover letter, social media profiles (e.g., LinkedIn), and any other information that you submit as part of your application.

When you click “Buy Online” on our Website, you are redirected to our online store, which Oracle NetSuite (“Oracle”) hosts on our behalf. Once there, you may be asked to register an account with us and to enter your contact, payment and other information in order to complete the purchase of one of our products or services.

The information that you provide in each case will vary. In some cases, you may be able to provide information via email or free text boxes, such as contacting Pure Wafer to request further information. When providing your information, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers or other sensitive personal data, unless required for our services.

Automated Information Collection. When you visit our website, open an email that we send you, or interact with us on social media platforms, we may also automatically collect information about you by automated means. In some instances, we may also allow third party advertisers and service providers to collect information about you through automated means. Some of the technologies behind this automated collection include::

  • Cookies: Cookies are small text files that websites send to your computer or other Internet-connected device to uniquely identify your browser or to store information or settings in your browser. Your browser may tell you how to be notified when you receive certain types of cookies and how to restrict or disable certain cookies. Some cookies may exist for only a single session and some are persistent for multiple sessions over time. We may use cookies that are managed by Pure Wafer or by third parties (such as social media website cookies) for the purposes explained in this Privacy Statement, including for session management, authentication, user preference storage, Website performance and personalization, Website analytics, advertising, content management, sales, search, security, and social media integration.
  • Web server logs: In conjunction with obtaining information through cookies, our web servers may log your IP address and related details regarding your device, operating system, or information about your Website usage, such as when you accessed our Website and the pages you visited.
  • Web beacons, pixels, and analytics software: To control which web servers collect the information described above, we may place tags on our Website or in our emails called “web beacons” or “pixels.” These are computer instructions that link web pages to particular web servers and their cookies and help us to better understand our Website traffic. Web beacons and pixels can be used to track the pages you view, links that you click, or other online behavior. These tools may also be used to increase and measure the effectiveness of our online and email marketing campaigns (such as by identifying the individuals who open or act upon an email message), allowing us to target individuals who may be most interested in our advertising. These tools also help us to understand when an email message is opened, how many times it is forwarded, and whether any hyperlink within it is clicked, as well as the type of software, device, operating system and browser used to deliver an email to us. Such tools are also used in connection with online advertisements on our Website and on third party websites to collect the same types of information with respect to individuals who click on advertisements.
  • Other: We may use other technology to collect information for the purposes described in this Privacy Statement.

Such technologies may permit collection of data elements such as demographic data, browser type, MAC address and other unique device information, operating system type and settings, domain, the address of the web page that linked you to our Website, IP address, pages visited, whether you have visited us before or are new to our Website, activities conducted on a particular webpage (such as search queries), and the day and time of your visit. If you access our website from a mobile device, we may collect your precise location using GPS, cell tower, Bluetooth, or WiFi signals. This information may be correlated to other data that identifies you specifically.

While most web browsers offer settings that will allow you to disable or delete cookies, if you do so, you may not be able to use our Website fully. If you make this change after you have visited our website, you may also have to manually delete existing cookies from your computer or other device.

Our Website may also contain embedded plugs-ins, widgets, pixels, or other programming associated with various external social media platforms (e.g., LinkedIn, Facebook, Google+, and Twitter). When you encounter those embedded objects, your web browser may establish a direct connection to the social media platform’s services and in doing so, share information such as your behavior while browsing our Website, your public profile, and content you may have posted publicly. This Privacy Statement does not apply to the privacy practices of external social media platforms.

For example, if you click on an advertisement on this Website, you may be taken to another website that we do not control. These links are not endorsements of these websites, and this Statement does not extend to them. Because this Statement is not enforced on these third-party websites, we encourage you to read any posted privacy policy of the third-party website before using the service or website and providing any information.

6. Your California Rights

Shine the Light law. Pursuant to California Civil Code Section 1798.83, we will not disclose or share your personal information with third parties for the purposes of third-party marketing to you without your prior consent.

Do Not Track Signals. Other than as disclosed in this Privacy Statement, our Website does not respond to Do Not Track (“DNT”) beacons sent by browser plugins as there is not yet a common agreement about how to interpret DNT signals from browsers. The Website does not track users over time and across third-party websites to provide targeted advertising. Therefore, the Website does not operate any differently when it receives DNT signals from your internet web browser.

WE DO NOT SELL YOUR PERSONAL INFORMATION. If we ever decide to sell personal information, we will update you via this Privacy Statement and include a link entitled “Do Not Sell My Personal Information,” to provide you with an opportunity to opt out of sales of your personal information.

California Consumer Rights. If you are a California consumer, as defined by the California Consumer Privacy Act of 2018, you may be afforded additional rights with respect to your “Personal Information” as that term is explicitly defined under California law. Any Personal Information we collect is collected for the commercial purpose of effectively providing our services to you, as well as enabling you to learn more about, and benefit from, our services. You may exercise each of your rights as identified below, subject to our verification of your identity.

  1. Access. You have the right to request that we disclose certain information to you about our collection, use and disclosure of your Personal Information over the past twelve (12) months. Any disclosures we provide will only cover the 12-month period preceding the receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
  2. Prohibit Data Sharing. When applicable, you may prohibit the sharing of your Personal Information. In your request, please explain how you wish us to prohibit the sharing of your Personal Information, and which categories of third parties you want to prohibit from receiving your Personal Information. When such prohibitions are not possible to provide our services to you, we will advise you accordingly. You can then choose to exercise any other rights under this Policy.
  3. Portability. Upon request and when possible, we can provide you with copies of your Personal Information. When such a request cannot be honored, we will advise you accordingly. You can then choose to exercise any other rights under this Policy
  4. Deletion. You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. Where applicable, we will ensure such changes are shared with trusted third parties.
  5. Non-Discrimination. If a California data subject exercises his or her rights under California law, including the CCPA, we shall not discriminate against that California resident by denying our goods or services, charging different prices or rates to similarly situated consumers, providing a different level or quality of our goods or services, or taking any other adverse action.
  6. Exercising your rights. If you are a California resident who chooses to exercise the rights listed above, you can:
    1. Submit a request via email at privacy@purewafer.com; or
    2. Call us at 1-408-945-8112 to submit your request.

Only you, or someone legally authorized to act on your behalf, may make a request related to your Personal Information. If an authorized agent makes a request on your behalf, we may require proof that you gave the agent permission to submit the request.

Responding to Your Request. Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the Personal Information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like for us to in fact delete your Personal Information before acting on your request.

We will respond to your request within forty-five (45) days. If we require more time, we will inform you of the reason and extension period in writing.

In some cases our ability to uphold these rights for you may depend upon our obligations to process Personal Information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, listed below, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request. We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
